Restraining orders relating to family law are court orders for the purpose of restraining (holding back or keeping in check) one party from abusing the another party. This is to protect the party that has been harmed in some fashion such as domestic violence or other form of abuse. It is intended to keep the abuser away from the victim.

Temporary Restraining Orders (TRO)

A temporary restraining order can be issued by a court on an immediate basis to protect the victim from domestic violence until a hearing is held to review the full situation.

Court Appearance

The temporary order lasts until a court date is set at which time the judge will decide to continue or cancel the TRO. Only a judge can change the order and it could be in force for several years. A child custody order typically has a different end date-usually when the child reaches the age of 18.

Restraining orders can order the restrained party to:

  • Have no contact with you, your children or other relatives
  • To physically move out of your residence
  • Comply with child custody orders
  • Pay child support
  • Pay spousal support

Domestic violence includes assault, criminal trespass, harassment, sexual assault, stalking and is taken very seriously. If the restrained person doesn’t obey the order, then call the police. The restrained person can be arrested and charged with a crime.
